Terms of sale Version 1.1. These sales conditions apply to all sales through mialandsem.no to consumers.

The terms of sale together with your order, confirmed through an order confirmation, constitute the overall contractual basis for the purchase.

The conditions are numbered consecutively in case of changes. We will keep information about which version of the terms of sale applies to your order. The version number is repeated on the order confirmation.

Consumer purchases are regulated in the Consumer Purchases Act, the Right of Cancellation Act, the Marketing Act, the Personal Data Act, the E-commerce Act and the Credit Purchases Act. Read more about these at www.lovdata.no.

Where the conditions of sale require written notice, this is fulfilled by using e-mail, text message to a mobile phone (SMS) or letter.

1. Parties

The seller is Landsem AS, hereinafter called Mialandsem.no, Lysaker torg 25, 1366 Lysaker, registered in the Brønnøysund register (www.brreg.no) with organization no.: NO 922 539 065 , telephone: 23 22 22 22, e- post: post@mialandsem.no, and will be referred to in the following as "we" or "us".

Buyer is: the person stated as the buyer in the order, and is hereinafter referred to as "you", "you", "your" or "your".

2. Order and agreement process

Your order is binding when the order is registered on our server (computer). You are responsible for reviewing your order before confirming and paying. Mialandsem.no is also bound by your order if it does not deviate from what is offered by us in our online shop, or in our marketing. You still have the right to withdraw from the purchase in accordance with the Act on the right of withdrawal, see clause 11 of the agreement.

When mialandsem.no receives your order, we will confirm the order and automatically send an order confirmation to the email address you have provided on the order page. Read the order confirmation carefully when you receive it and check whether the order confirmation is in accordance with the order.

Deviations between your order and the order confirmation are considered a new offer from us, which you can accept or decline.

3. Information provided in the online store

Mialandsem.no strives to give our customers as correct information about our products as possible. However, we reserve the right that image/typing/printing errors and incorrect pricing may occur, which may mean that we cannot deliver according to information provided in our online store or our marketing.

Furthermore, we reserve the right to cancel or change your order or parts thereof, if the product is sold out or a price/printing error has occurred. In the case of sold-out situations, you will be notified of this, possibly together with information about what we can offer instead. You will have the option to accept our new offer with the changes we specify in relation to your order, or cancel the order.

4. Prices

All prices include VAT. The total cost of the purchase will appear before payment and include all expenses associated with the purchase such as expenses for postage, shipping, packaging, environmental tax etc.

5. Payment

The purchase price can be settled through Vipp's payment. To be able to shop at Mialandsem.no, you must be 18 years old.

6. Delivery and delay

Mialandsem.no only delivers to addresses in Norway

Delivery of the products takes place in the manner, at the place and at the time indicated on the order confirmation. Mialandsem.no bears the risk for the products until they are taken over by you, i.e. when you have received the products in your possession.

If the delivery of the products is delayed, we will give you information as soon as we are aware of it, together with information about and possibly when delivery can take place, or whether the product(s) are sold out.

Depending on the length of the delay, you can, depending on the circumstances, withhold the purchase price until delivery is made, or terminate the agreement.

7. Unclaimed package

If you fail to pick up the package at the post office, you will receive an invoice for unclaimed shipment, this to cover our shipping costs and fees to the carrier.

For undelivered packages that are returned to us, you will be charged a fee of NOK 400, including VAT

8. Examination of the products

After you have received the products, you must, as soon as you have the opportunity to do so and within a reasonable time, check whether the delivery is in accordance with the order confirmation, whether the products have been damaged during transport, or whether the products otherwise have faults or deficiencies. This also applies if you have chosen a recipient of the goods other than yourself (the payer).

9. Your rights in the event of errors and omissions (Complaint)

If the products are faulty or missing, you can, depending on the circumstances, demand rectification of the fault, redelivery of a new equivalent product, price reduction, or cancellation of the purchase. Mialandem.no can always demand that the purchase be canceled, rather than error correction, redelivery and price reduction.

The error must be present when you receive the products in your possession.

Notification of errors and defects in the products can be conveyed to us verbally, but must always be confirmed in writing. This must be done within a reasonable time after you discovered the error or deficiency. You still always have at least a two-month complaint deadline.

M i alandem .no will confirm receipt of all complaints in writing. M i alandem .no will also confirm receipt of goods sent back to us for inspection or error correction in writing.

The right to advertise applies for two years after you have taken over the product, or five years if the product is intended to last significantly more than two years. The right to complaint is in addition to the right of withdrawal according to section 11.

10. Warranty

Our guarantees do not imply any restrictions on the complaint deadline for goods according to the Consumer Purchase Act. The complaint deadline is two years after you took over the item, or five years if the item is intended to last significantly more than two years. See also section 9.

11. Right of withdrawal

The Right of Cancellation Act gives you the right to cancel your purchase. The right of withdrawal applies to goods (not shipping and fees)

The right of withdrawal requires that you notify us of this no later than 14 days after you receive the delivery (withdrawal period). Such notice must be given on the right of withdrawal form attached to the delivery. If you have not received a right of withdrawal form by mistake, you can download such a form here

In order for the right of withdrawal to be exercised, the product must be unused, in the original packaging, and otherwise in the condition in which you received it.

If you use the right of withdrawal, the product(s) must be returned to us within a reasonable time. Any return shipping must be paid for by you. You are responsible for ensuring that the product is properly packed for return transport. We also have other risks for the transport back to us.

If you cancel the entire delivery (i.e. return all the products from an order), we will refund the full amount, but excluding shipping costs for the shipment to you. If parts of an order are returned, the price of the products to which this applies is refunded. The refund must take place within fourteen days after we receive the product in return. If the order was paid for by card, the refund will be made to the card that was used. In other cases, the refund will be made to the account number you provide on the return form.

The product(s) must be sent back to us in original packaging (incl. manuals, etc) and together with a right of withdrawal form. More information on how to make use of the right of withdrawal can be found in the return form.

The right of withdrawal does not apply to CDs or DVDs when the seal on the product has been broken.

If you have chosen invoice as a payment solution and want to use the cancellation period, you must pay the invoice anyway in order to get this refunded from Landsem AS. If you fail to pay the invoice from Klarna, you will be charged for any dunning and collection costs.”

12. Personal data

Mialandem.no basically only processes personal data that is necessary for us to be able to carry out our obligations towards you.

In cases where M i alandem.no also processes personal data for other purposes, for example to send you information about offers etc., this is only done when you have consented to it. Before you consent, you must be informed about what the information will be used for and by whom.

Your personal data will not be disclosed to others, unless it is necessary to carry out the purchase/payment, or if we are/will be legally required to do so.

As of today, M i alandem .no has the following operating partners who receive transfer of personal data:

  • Posten/Bring (Delivery/payment)
  • Vipps (Payment)
  • Shopify (Online store - server operation)

Operating partners do not have the opportunity to use personal information provided by Mialandsem.no for anything other than the agreed operating task.

13. Sales pledge

Mialandsem.no has a sales lien on the delivered products until the purchase price, including any interest and costs, has been paid in full.

14. Disputes

The parties shall attempt to resolve any disputes amicably. If this is not successful, you can bring the matter before the Consumer Council near where you live. All disputes must be resolved according to Norwegian law. If the case is brought before the courts, it must be decided in your (the buyer's) jurisdiction, which normally means close to where you live.
